Terms of Service

These Terms of Service ("Terms") govern your access to and use of the 4cast website at 4cast.io, the 4cast application at platform.4cast.io, and related services (together, the "Service"). 4cast is provided by Blue Bison Analytics, Inc., a Delaware corporation ("Blue Bison," "we," or "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Signed customer agreements

If your organization has signed a License and Services Agreement with Blue Bison, that agreement governs your use of the 4cast application. If these Terms conflict with a signed agreement, the signed agreement controls. These Terms apply to the website and to any other use of the Service that a signed agreement does not cover.

Use of the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your organization's internal business purposes. Access is limited to individuals we have authorized. You must keep your login credentials confidential, you may not share them, and you are responsible for all activity under your account. You must give us accurate information and use the Service in compliance with applicable law.

Restrictions

You may not: (a) allow anyone other than an authorized user to use the Service; (b) resell, sublicense, or make the Service available to third parties, including through a timesharing or service-bureau arrangement; (c) decompile, disassemble, reverse engineer, or attempt to discover the source code or underlying algorithms of the Service; (d) create derivative works of the Service; (e) benchmark the Service or publish benchmark results; (f) use any robot, spider, scraper, or other automated or manual process to copy or monitor the Service, except as we expressly permit; or (g) interfere with or disrupt the Service or its security. We may limit access if your use places a disproportionate demand on the Service.

Ownership

As between you and us, Blue Bison and its licensors and third-party data providers own the Service and all related intellectual property rights, including all copies and derivatives. We reserve all rights not expressly granted in these Terms. You keep ownership of the data you submit to the Service, and you grant us the right to process it to provide the Service.

Data accuracy and no advice

The Service uses public record and third-party data. Source data is sometimes reported or entered inaccurately, processed incorrectly, and is generally not free from defects. The Service is not the source of the data and is not a comprehensive compilation of it. Forecasts, valuations, economics, and other outputs are estimates and are not guarantees of future production, reserves, or returns. Independently verify any data or output before relying on it. Nothing in the Service is investment, financial, legal, tax, or engineering advice.

Third-party data and services

The Service includes data and services from third parties, including Rextag and NuTech. Your dealings with any third-party provider, including any terms that apply to their data, are solely between you and that provider. Blue Bison is not responsible for any loss or damage resulting from those dealings.

Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, BLUE BISON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR AVAILABLE AT ALL TIMES.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BLUE BISON WILL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS. BLUE BISON'S TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID TO BLUE BISON FOR THE SERVICE IN THE SIX (6) MONTHS BEFORE THE CLAIM AROSE.

Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if your use creates a security risk or harms the Service. Provisions that by their nature should survive termination will survive, including ownership, data accuracy, disclaimer, limitation of liability, and governing law.

Text message support

We use text messaging only to reply to customer support requests. See our SMS Support page for how to opt in and opt out.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above shows the latest version. If you keep using the Service after an update, you accept the updated Terms.

Governing law and venue

These Terms are governed by the laws of the State of Oklahoma and the United States, without regard to conflict-of-law principles. Venue and jurisdiction for any dispute lie exclusively in Oklahoma County, Oklahoma.

General

If any provision of these Terms is held unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them to a successor to our business. These Terms, together with any signed agreement, are the entire agreement regarding the Service and replace prior understandings on that subject.
